Terms and Conditions
The orders and the Business Conditions shall be governed by Act No. 89/2012 Coll., the Civil Code, as amended
Business Conditions (“BCs”):
1. Factual Scope of Application
The following conditions shall regulate the client’s and the Hostel Operator’s mutual rights and obligations with respect to personal reservations at the hostel’s reception or through electronically concluded commercial contracts.
1.1 Each of the accommodation facilities advertised at www.hostely-praha.cz and www.kolbenka.com has its own reservation system. After the customer selects the respective accommodation facility, he/she shall receive due and comprehensible information on the accommodation facility of his choice. If the customer makes an identical reservation in more accommodation facilities presented on the websites stated above, he/she shall be supposed to need a reservation in all of these accommodation facilities and shall pay the applicable prices.
1.2 Electronic Conclusion of a Commercial Contract; Subject and Scope of Performance:
The commercial contract shall be concluded, upon the completion of the reservation form, once consent to the Business Conditions is granted and the ‘make a reservation’ or ‘complete the order’ box is clicked on. No reservation can be sent in the event of dissent to the Business Conditions.
1.3 Accommodation Reservation:
The client shall duly and truly complete all compulsory details in the reservation form in manner such that the Hostel Operator is not misled, and shall send his/her enquiry. Once his/her order is sent through the online reservation system located to this effect on our websites www.hostely-praha.cz and www.kolbenka.com, the client shall be notified of the acceptance (inclusion or non-inclusion) of the demanded reservation within 60 minutes to his/her e-mail address stated in the order.
1.4 No Receipt of Reservation Confirmation:
If the client does not receive a confirmation of his/her reservation within the stated time, there might be technical problems not caused by the Hostel Operator, such as a wrong or incomplete e-mail address entered in the reservation form, the client’s full mailbox, or the message included under SPAM (unsolicited mail). In these cases, the Hostel Operator shall not be responsible for failed notification. If the client does not receive such notification/message, he/she may verify the status of his/her order by phone and, possibly, specify or report another functional e-mail address where the information on his/her reservation shall be sent. Please note that this confirmation shall not be sent in the form of an SMS to the client’s cell phone.
1.5 If there are technical problems with the Internet connection on the part of the Hostel Operator and the client does not receive the stated information within 60 minutes, this information/message shall be sent immediately after the Internet supplier renews the connection. In such case, the client may obtain information on the availability and status of his/her order by phone on the phone numbers stated in the contacts of the accommodation facility where his/her reservation has been made. Once the Internet connection is renewed, this information/message shall be sent to the client immediately.
1.6 Reservation Status-related Information:
The availability of the demanded services and accommodation shall always be confirmed in the header of the answer of the confirming message. Once the consent to the Business Conditions is granted, the notification “Your reservation has been properly sent” shall pop up. Subsequently, the client is sent to his/her e-mail address an automated reply with initial information. The Hostel Operator shall not be responsible for wrong or incomplete details entered by the client in the form and shall process the reservation as stated by the client in the order. The client shall receive at his/her e-mail address stated in the order a reservation confirmation (voucher) stating the reservation number, the price, the arrival time, and the instructions on how to proceed further. In the check-in, every guest shall submit his/her valid identity card. If a guest does not submit his/her valid identity card, he/she shall not be accommodated.
1.7 The accommodation prices shall be governed by the applicable pricelist available on www.kolbenka.com or www.hostely-praha.cz where the prices per season and room type are always current and valid. The price stated in the voucher shall always be valid and no adjustments of prices or changes of dates reserved by the Hostel Operator shall affect the price stated in the voucher.
1.8 The client and the accommodation facility operator shall be entitled to withdraw from the bilaterally unconfirmed order in writing (by e-mail) only. Such withdrawal should be made by the person who has made the reservation based on the contacts stated in the order (e-mail address or phone number). If the reservation is confirmed or cancelled by a person other than that who has made the reservation, such person shall be considered as having been authorized by the client. Such confirmation shall not affect the rights and the obligations of both parties. The operator shall be represented by the worker serving as the receptionist on the given day. The operator or the client shall always state the reason for cancelling the reservation.
1.9 Reservation Confirmation:
A reservation needs to be confirmed at the latest the day prior to the arrival day stated in the order and by 1200 hours and in writing by e-mail to the e-mail address stated in the voucher. Unconfirmed reservations shall be automatically excluded and the client shall not be entitled to the accommodation. If, despite this, the client sends the confirmation after the stated time, the reservation shall not be considered as valid. The client shall be notified of the re-inclusion of his/her reservation by the hostel’s receptionist in writing. If the receptionist renews the reservation, the reservation shall be considered as valid and shall be subject to the Business Conditions and the cancellation fees. Reservations made the same day as the arrival day need to be confirmed in writing immediately to the e-mail address stated in the voucher. Reservations confirmed in writing outside the dates and times stated above shall be considered as binding and shall be subject to the cancellation fees as per the Business Conditions.
2.0 Payment Method:
2.1 No down payments shall be required for individual reservations the total value of which does not exceed CZK 5,000 and which are made in cash or with a payment card upon arrival at the hostel’s reception.
2.2 Upon request, the client shall be entitled to remit the total price of his/her reservation to the Hostel Operator’s account stated in the given hostel’s contacts without being called on to do so by the Hostel Operator. To this end, at the client’s request, the hostel’s receptionist shall send the client to his/her e-mail address stated in the order the necessary information on the account number, the due date and the variable symbol of the payment for his/her reservation. The payment may also be made by payment card.
2.3 A down payment made in cash, by payment card or via a transfer into the Hostel Operator’s account and corresponding to approximately 60 % shall be required for reservations the value of which exceeds CZK 5,000. This down payment shall be subject to the cancellation fees as per the applicable Business Conditions. If the payment is made via a transfer into the account, it shall usually be due for reimbursement within fourteen days of the reservation date and the sending of the call for payment to the client. If needed, it is possible to adjust the maturity period upon agreement. The due date shall mean the date on which the respective sum shall be credited to the account rather than the date on which the sum shall be sent.
2.4 For the reservations of lucrative dates such as public holidays (Easter, New Year’s Eve, etc.), the Hostel Operator shall require the payment of the total price (100 %) of the requested reservation in cash, by payment card or via a transfer into the Hostel Operator’s account. Once paid for, these reservations cannot be changed or cancelled. Once such reservation is paid for, it shall be considered as binding and shall be subject to 100% cancellation fees pursuant to the conditions applicable to the cancellation fees as stated herein. If the payment is made via a transfer into the account, it shall be due for reimbursement within 24 hours of the reservation date or the sending of the call for payment to the client. If needed, it is possible to adjust the maturity period upon agreement. The due date shall mean the date on which the respective sum shall be credited to the account rather than the date on which such sum shall be sent.
2.5 The respective payment may be transferred into the account under the assigned variable symbol (reservation number). This symbol shall serve for identification of the payment and must always be stated. If the client fails to state the variable symbol in his/her payment or states a wrong variable symbol, the payment does not need to match the particular reservation. The Hostel Operator shall not be liable for any possible error in matching payments by reason of missing variable symbols. In such case, the client will be made to make the payment in cash at the hostel’s reception. Once the payment is correctly matched to the given reservation, the cash shall be returned to the client.
3.0 Cancellation, Change and Adjustment of Reservations without Cancellation Fees:
3.1 Reservations made without an advance payment (down payment or the whole sum) may be changed, modified or cancelled by the client without any cancellation fees and sanctions at the latest by 1200 hours on the day prior to the scheduled arrival day stated in the reservation. Orders not confirmed in writing can be cancelled without sanctions at the latest by 1200 hours on the day prior to the arrival day stated in the order.
3.2 Reservation Cancellation by Hostel Operator without Compensation:
3.3 The Hostel Operator shall be entitled to cancel the client’s reservation for operational or technical reasons and shall always notify the client of this fact, using the contact details stated in the client’s reservation, but first in writing to the stated e-mail address at the latest by 1200 hours on the day prior to the arrival day stated in the order. In such case, the Hostel Operator may offer the client the accommodation in one of the other facilities stated on www.hostely-praha.cz. In such case, the client shall not be obliged to make use of such offer and no cancellation fees or other sanctions shall apply to such cases.
3.4 If the Hostel Operator cannot provide the client with the already ordered accommodation as per the client’s reservation for operational or technical reasons and such reservation has been duly confirmed by the client in writing by 1200 hours the day prior to the arrival day stated in the order, the Hostel Operator shall be obliged to arrange substitute accommodation for the client in Prague in any of the other accommodation facilities presented on www.hostely-praha.cz and for the same price as for the original accommodation. If the price of the substitute accommodation is higher than the price of the originally ordered accommodation, the difference shall be borne by the Hostel Operator. The client shall be notified of this fact without delay to the contacts stated in his/her reservation, but first in writing to the stated e-mail address. However, the client shall not be obliged to make use of such offer and no cancellation fees shall apply to these cases.
3.5 Reservation Cancellation Subject to Cancellation Fees:
3.6 Cancellation fees shall apply to cancelled and unimplemented reservations if the client has duly and demonstrably confirmed his/her reservation in writing in compliance with the Business Conditions. Reservations confirmed in writing cannot be cancelled or changed without cancellation fees.
3.7 Cancellation of Reservation Already Confirmed by Client:
If the client cancels the already confirmed reservation, he/she shall be obliged to compensate the Hostel Operator for all costs incurred as a result. The minimum cancellation fee shall always be determined based on the order and the pricelist for one night of the overall reservation. The cancellation fee upon the first electronic call sent to the e-mail address stated in the order (reservation price calculated for one night) shall be due for reimbursement at the latest within 14 days of the call for payment. The client shall be sent the call for payment to the e-mail address stated in the order. The call for payment shall state the due date, the total sum to be paid, the variable symbol, the account number, and the reservation-related documents. The invoice for payment shall be sent only after the respective sum is credited to the Hostel Operator’s account and shall be in the PDF form as permitted pursuant to Act No. 235/2004 Coll., as amended by Act No. 319/2006. The failure to reimburse the costs within the set time-limit shall constitute gross breach of the commercial contract and the contractual conditions by the client and, subsequently, the claim shall be handed over to a law firm for recovery. The client shall then be called on by the Hostel Operator’s lawyer in writing to pay the total cancellation fee stated above as per the applicable pricelist, a contractual penalty of CZK 500, and default interest to the tune of 0.3 % of the amount due per day.
3.8 If no valid identity card is submitted upon arrival, the guest shall not be accommodated and the reservation shall be considered as cancelled and shall be subject to the cancellation fee as per paragraph 3.6 of these BCs.
3.9 If the cancellation fees are paid in due and timely upon the first call for payment, the Hostel Operator may allow the client to be accommodated for these funds. However, the client has to ask the Hostel Operator for this in writing upon timely payment and immediately once receiving the notice of the respective sum having been credited to the Hostel Operator’s account. The substitute reservation must be of an identical nature and for an identical price, which shall be paid within 90 days of the request. This request shall be confirmed for the client in writing by the hostel’s receptionist.
4.0 Cancellation fees applicable to reservations subject to a down payment or full payment in advance:
4.1 The cancellation of a reservation subject to a down payment or to full payment for accommodation in advance must be reduced to writing (sent by e-mail) and confirmed by the receptionist in writing immediately in the same manner. If the cancellation fees are lower than the paid advance or the total payment, the difference shall be returned to the client via a transfer to his/her account.
4.2 The following cancellation fees shall apply to down payments and total payments:
If the guest cancels his/her order for which a down payment or the total payment in advance has been made, then:
Cancellation 30 – 23 days prior to arrival – 30 % of the price of accommodation (70 % of the price to be refunded)
Cancellation 22 – 15 days prior to arrival – 50 % of the price of accommodation (50 % of the price to be refunded)
Cancellation 14 – 10 days prior to arrival – 70 % of the price of accommodation (30 % of the price to be refunded)
Cancellation 9 – 5 days prior to arrival – 90 % of the price of accommodation (10 % of the price to be refunded)
Cancellation less than 5 days prior to arrival – 100 % of the price of accommodation (0 % of the price to be refunded)
4.3 The reservations of lucrative dates, such as public and other holidays (Easter, Christmas, New Year’s Eve, etc.), that have already been fully paid for shall be binding and, if cancelled, shall be subject to a cancellation fee of 100 % and paragraph 4.8 of these BCs shall not be applicable to them.
4.4 Changes of an order for which the client has already paid an advance or the total sum in cash, by card or via a transfer: Change in the reservation shall mean change in the number of persons, days or rooms. A reservation may be changed without sanctions within 30 days prior to arrival.
4.5 Changes made in a period shorter than 30 days prior to arrival shall not result in a decrease in the total price!
4.6 Changes in Reservations upon Payment for Accommodation in Cash at the Reception:
4.7 If the already paid accommodation is curtailed or cancelled, the guest has already been accommodated, and the unused part of the reservation does not exceed five days, the client shall not be entitled to be refunded the payment for accommodation or its proportionate part. If the number of days on which the accommodation was not completed exceeds five nights, the client may be refunded 50 % of the price of the accommodation not made use of by him/her, that is, only of the unused accommodation exceeding the mentioned five days, which shall be determined from the date of the request for termination of the accommodation/stay rather than from the date stated in the reservation. The accommodation must be terminated on the set day by 1000 hours. After this time, it shall concern an eligible day, which cannot be included in the right to be refunded for the not fully used reservation.
4.8 The client may also be offered compensation in the form of accommodation on another date for the same price as per the pricelist. However, in such case, it is necessary to make the reservation at least one week beforehand. The reservation shall be confirmed by the receptionist in writing (by email) and its inclusion in the reservation system shall be approved. The client shall be issued a confirmation of this compensation, which shall be valid for 3 months of issue. The possible extension of such confirmation may be determined only by the Hostel Operator’s management on case by case basis and cannot be claimed.
4.9 The Hostel Operator reserves the right not to accommodate guests or to cancel reservations if the Accommodation Rules or these BCs are not adhered to.
5.0 The client agrees that in the event of litigation, the jurisdiction of the plaintiff’s court shall apply pursuant to Section 89a of the Civil Procedure Code.
5.1 Personal Data Protection:
5.2 By sending a completed order and confirming the Business Conditions, the client consents to his/her data, being the name and surname, telephone and email as entered in the reservation, the details ascertained from his/her identity card or another identity document upon arrival, the personal document number and the birth date, being processed. This data shall serve, in particular, for the needs of the control authorities (Police of the Czech Republic and CPCR). This data facilitates the Hostel Operator’s processing of clients’ future orders. The Hostel Operator shall not disclose the clients’ personal data to any third parties.
5.3 The clients/guests shall be obliged to familiarise themselves with, and adhere to, the Accommodation Rules and these Business Conditions, which can always be found in a visible place at the hostel’s reception or on our website.
